18 March lecture - common law

Law of Persons

- who does the law recognise other than natural persons?

- why would that be important in the environmental context? Check out s340 of the RMA.

Contracts

- how is a contract made? Is writing required? Consider how much of our current society is reliant on contract law and how contract law can affect the environment.

Torts

- what are the different types of torts (civil wrongs)? Which ones are most useful in environment law?

Land Law

- what is real property? In NZ law, if you 'own' land, do you own the soil itself, or something else?

- look quickly at the RMA. What does it say about ownership of land? What is going on in section 122?
